In-form Kerrin McEvoy has been confirmed as the new rider of Doomben Cup favourite Metal Bender following Hugh Bowman's decision not to seek a stay of proceedings against a careless riding suspension.

The top Sydney jockey gave serious thought to taking further action in the Queensland Civil and Administrative Tribunal (QCAT) to enable him to ride Metal Bender in Saturday's 2020-metre Group One weight-for-age feature.

Bowman lost a first-level appeal on Monday against an eight-meeting ban for careless riding at the Gold Coast on May 8.

"I've decided not to appeal because I've basically run out of time," Bowman said.

"The jockeys have to be declared for the Doomben Cup by tomorrow but the stewards have another 24 hours to submit their submission if they want to oppose a stay of proceedings.

"I can't accept any ride without getting a stay of proceedings."

Waller named McEvoy as Bowman's replacement on Tuesday afternoon and has booked Larry Cassidy for stablemate Triple Honour in the Doomben Cup.

Bowman will now sit on the sidelines until his suspension expires the day before he is due to ride Ortensia in the Group One Doomben 10,000 on Saturday week.

His decision not to take further action against his suspension places him at some risk of maintaining his association with Ortensia in next month's $1 million Stradbroke Handicap at Eagle Farm.

He was only booked to ride Ortensia for her opening two winter carnival starts in last Saturday's Group One BTC Cup and the Doomben 10,000 following regular jockey Craig Williams' decision to ride in Japan until the Group One Stradbroke on June 12.

Bowman struggles with his weight and can't afford to sit idle during his period out if he hopes to fend off Williams' challenge to be reunited with Ortensia for the Stradbroke.

No rider has been confirmed for Ortensia in the Stradbroke but Bowman believes he will become the frontrunner if he can win the Doomben 10,000.

Ortensia has a featherweight 53.5 kilograms in the Stradbroke, a weight Bowman hasn't ridden for years.

"I could ride her if given some notice," Bowman said.

"But the first thing that has to happen for me is to win the 10,000 on her."

Bowman normally rides at 54 kilograms but it's a struggle every day and the suspension won't assist his chances of overcoming his weight battle for the Stradbroke.

The last time he recalled riding at a light weight was when he got down to 52.5kg to ride the Guy Walter-trained Zingam when the gelding finished fifth to Portland Singa in the Group One Brisbane Cup in 2005.

"That was a long time ago," Bowman said.

"I walk around at 56 kilos most days and I have to lose a couple of kilos every day to ride 54.

"When I'm riding regularly my weight settles down but this suspension won't help."

Williams telephoned Ortensia's trainer Tony Noonan twice over the weekend to inquire how the mare performed and pulled up following her fifth to Albert The Fat in her BTC Cup assignment.
