McEvoy was found guilty of not giving Shakes every opportunity to win or obtain the best placing in a race at Randwick on March 18.

The Racing NSW Appeal Panel found that although McEvoy made what it considered an error of judgment, it was not an error of a culpable level and did not amount to a breach of the rules.

Stewards ruled McEvoy had failed to take all reasonable measures near the 600m mark of the 1400m race by not taking the opportunity to improve outside another horse and get a clear run home.

Shakes was held up in the straight until the 200 metres and finished third.

The number one rider for Sheikh Mohammed's Darley Australia, McEvoy has been riding under a stay of proceedings while waiting for the appeal to be heard.

Although McEvoy did not ride a Group One winner during the Sydney autumn, he and Darley trainer Peter Snowden capped a great weekend when Kidnapped won Sunday's South Australian Derby.

On Saturday, Snowden prepared four winners at the showpiece Hawkesbury meeting while McEvoy celebrated a treble with two of his wins coming for Snowden.
