The fall in which Kerryn McEvoy was seriously injured last month has been ruled accidental but apprentice Tim Bell has been outed for improper riding for another incident in the race.

Bell won the Takeover Target Stakes on Border Rebel at Gosford on June 23 while McEvoy suffered a serious back injury when he fell from Skytrain after attempting a run to that horse's inside.

Although they ruled no rider was at fault for the fall, the stewards' panel headed by Marc Van Gestel had concerns over Bell raising his right elbow and making contact with Skytrain before the horse came down.

The apprentice is considering appealing the three-week suspension which will rule him out of the ride on Border Rebel in the Missile Stakes on August 7.

McEvoy, who expects to be out for another three months, told Wednesday's resumed inquiry the incident happened quickly and he could not recall all the details.

He watched the video which showed him moving up to take the narrow run after Border Rebel shifted out rounding the turn but the gap quickly closed when Bell straightened his mount.

Skytrain struck heels and came down causing a ricochet effect which led to apprentice Alex Stokes coming off Newton's Rings.

"You are entitled to pitch for the run but we remind you to exercise care," Van Gestel told McEvoy.

"But there is no finding against any rider for the fall."

Prior to the fall, Bell lifted his right arm and elbow and appeared to make contact with Skytrain's neck.

"You are riding desperately to win the race and your elbow makes contact with Skytrain," Van Gestel told Bell.

"We don't say this incident has any bearing on Skytrain falling.

"(But) it is an undesirable action."

Bell said it was not a deliberate act on his part and he was doing all he could to keep Border Rebel balanced.

"If I made contact it was accidental," he said.

"I'm out there riding the best I can to win a big race."

Van Gestel said the improper riding charge did not indicate intent and if stewards felt there had been a deliberate act, a more serious charge of foul riding could have been applied.

"Accidental or not, it can still be improper riding," he said.

Bell's boss Sue Grills trains country star Border Rebel who is the winner of 12 of his 17 starts.

Bell has ridden the gelding to 11 victories but the Takeover Target Stakes had already come at a great cost.

He was suspended on the day for a careless riding incident earlier in the race and also fined $200 for waving his whip before the winning post.
