Chad Schofield’s legal counsel has lodged an application for a stay of proceedings for the young jockey pending the Victoria Civil & Administrative Tribunal setting a date for his appeal.

Paul O’Sullivan, who represented Schofield at his unsuccessful appeal last week to the Racing Appeals & Disciplinary Board against a 32-meeting suspension imposed by Racing Victoria stewards, lodged the application on Tuesday.

RV stewards have opposed the application so now a date has to be set by VCAT to hear the application.

Earlier, VCAT told O’Sullivan it was unable to hear Schofield’s appeal until the week beginning October 13.

O’Sullivan said that timeline, given Schofield’s suspension finishes at midnight October 17 (Caulfield Cup eve), led him to lodge an application for a stay.

He said he found the VCAT decision perplexing given both he and RV had requested that VCAT set aside an appeal date as a matter of urgency.
