Racing NSW has failed in its defence of the Federal Court case brought against it by bookmaking firm Sportsbet. Judge Nye Perram held that the 1.5% of turnover race fields levy was not validly charged to Sportsbet and is therefore fully refundable. The judgment will affect not only the levy paid by Sportsbet but all bookmakers covered by the Race Fields legislation.
