Judge Russell Lewis said: "A legal problem has arisen and as a result the appeal and charges will not be heard today...They will be adjourned to next Monday in front of a reconstituted board of appeal."
Interesting moves in the Danny Nikolic case. One is that his legal team is probably arguing that the same Board of Appeal who adjudicated against him last week cannot hear the current charges. This is supported by Judge Lewis's remark about a 'reconstituted board' next week. Secondly, the argument will be made that Nikolic cannot be convicted of making a threat to chief steward Terry Bailey if the only evidence is Bailey's claim - without other witnesses. Some legal experts believe racing authorities are on shaky ground.
Top galloper Whobegotyou has died at his owner Laurence Eales's property near Sunbury in Victoria. The former Mark Kavanagh-trained galloper had 29 races for 10 wins and 14 placings for prizemoney earnings of $3,263,450. Jockey Michael Rodd says: "Very sad news about my old mate Whobe, was a great horse to me...He had an incredible turn of foot. R.I.P buddy."
